ACOs don't violate antitrust laws, DOJ official says
Most accountable care organizations will not violate antitrust laws, a Department of Justice official told attendees of the Second National Accountable Care Organization Summit in Washington, D.C. Gail Kursh, deputy chief of the legal policy section of DOJ's antitrust division, said antitrust laws aren't meant to prevent ACOs from forming, but rather to prevent the removal of competition that could result in market power and price fixing, writes FierceHealthcare editor Karen M. Cheung. Most ACOs are highly unlikely to raise market concerns. "[The antitrust agencies] recognize that ACOs do have potential to improve care, but it's essential that ACOs don't eliminate competition that will raise prices or reduce choices for patients," Kursh said. --To learn more, read the full article in FierceHealthcare
